By using the MetricJunkie.com web site, a service of Innovention Lab, Inc., you are agreeing to be bound by the following terms and conditions ("Terms of Use").

Basic Terms

1. The Metric Junkie™ service is provided free of charge. No warranty or fitness is implied. By creating an account you understand this and assume any and all risk associated with using our service.
2. Metric Junkie is being made available to you in "Beta" form. This means that it is still under development and you may experience the following: less than desirable performance, total loss of data, reporting inaccuracies, inaccessibility, downtime, nausea, dizziness, frustration, and anger.
3. Our service relies on Sales Rank information provided by Amazon.com. We attempt to derive meaning from this data to draw conclusions and comparisons about sales and product market share. All data presented reflects a rough estimation at best. As a result, our service should be used for entertainment purposes only. If you require solid hard data to make serious business decisions with regard to an item or product you are involved with, look elsewhere.
4. You are responsible for any activity that occurs under your user name.
5. You are responsible for keeping your password secure.
6. You must not abuse, or misuse the Metric Junkie website.
7. You may not use the MetricJunkie.com service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
8. You are solely responsible for your conduct and any data, text, information, user name, graphics, photos, profiles, and links ("Content") that you submit, post, and display on the MetricJunkie.com service.
9. You must not modify, adapt or hack MetricJunkie.com or modify another website so as to falsely imply that it is associated with MetricJunkie.com .
10. You must not transmit any worms or viruses or any code of a destructive nature.
11. You must not, in the use of MetricJunkie.com, violate any laws in your jurisdiction (including but not limited to copyright laws).

Violation of any of these agreements will result in the termination of your MetricJunkie.com account. While MetricJunkie.com prohibits such conduct and content on its site, you understand and agree that Metric Junkie or Innovention Lab, Inc. cannot be responsible for the content posted on its web site and you nonetheless may be exposed to such materials and that you use the MetricJunkie.com service at your own risk.

General Conditions

1. We reserve the right to modify or terminate the MetricJunkie.com service for any reason, without notice at any time.
2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via internet mail. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
3. We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
4. We may, but have no obligation to, remove content and accounts containing content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
5. The Metric Junkie service makes it possible to post images and text hosted on Metric Junkie to outside websites. This use is accepted (and even encouraged!). However, pages on other websites which display data hosted on MetricJunkie.com must provide a link back to Metric Junkie.
6. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.
